Terms of Service
1. Acceptance
These Terms of Service (the “Terms”) are an agreement between you and FANG PENG (“we,” “us,” or “our”) governing your download, access, and use of Tressight (the “App” or “Service”).
By downloading, registering for, or using the App, you agree to these Terms and the Privacy Policy. Permission to send a photo to third-party AI providers is requested separately in the App and is not replaced by acceptance of these Terms.
2. Service
Tressight provides AI-powered hairstyle analysis and image generation, including:
- Analysis of visible face-shape and hair characteristics in a submitted photo;
- Reference suggestions about hairstyle length, bangs, hair color, and styling;
- AI-generated hairstyle and hair-color try-on images; and
- Account-based history, generated results, and favorites.
The Service does not provide medical or hair-loss diagnosis, cosmetic-medical services, identity recognition, or services from a licensed hairstylist. Available features are those shown in the current App version and purchase screens.
3. Eligibility and Accounts
You must be at least 13 and legally capable of agreeing to these Terms where you live. If you are below the age of legal majority, a parent or legal guardian must review and agree to these Terms and supervise your use.
You may create an account using Sign in with Apple or Google Sign-In. You are responsible for device and account security and must promptly notify us of unauthorized use. We may suspend an account involved in fraud, abuse, a security risk, or a serious violation of these Terms.
You may permanently delete your account through “Profile → Privacy → Delete Account.” Account deletion cannot be undone and deletes cloud photos, reports, generated images, and favorites associated with the account unless retention is legally required. Signing out or uninstalling the App does not delete your account.
Deleting your account does not cancel an Apple auto-renewable subscription. You must separately cancel through Apple's subscription management tools.
4. User Content and Processing License
You retain the rights you hold in uploaded photos and other original content. To provide the Service, you grant us and necessary service providers a worldwide, non-exclusive, royalty-free license, sublicensable only for service processing, to:
- Store, transmit, preprocess, and analyze photos;
- Generate, store, and display reports and try-on images; and
- Perform content safety, abuse prevention, troubleshooting, and legally required processing.
This license lasts only as long as necessary to provide the Service. It ends for deleted content when deletion is completed, except that isolated backups, security records, or legally retained copies may be processed for the necessary period.
You represent and warrant that:
- The photo is of you, or you have the depicted person's clear and sufficient permission;
- You have all rights needed to upload the content and grant this license;
- Your content and use will not violate privacy, publicity, copyright, or other rights; and
- You will not upload unlawful content or sexualized, exploitative, or otherwise inappropriate content involving minors.
5. AI Services and Outputs
The Service uses OpenAI models through the APIMart AI API gateway. AI services may be delayed, interrupted, refuse content, or fail to generate a result.
Reports and images are generated automatically and may be inaccurate, incomplete, biased, or different from real-world hairstyling results. Outputs may resemble outputs provided to others and may not qualify for copyright protection. We do not guarantee uniqueness, registrability, or non-infringement.
Subject to these Terms, you may use reports and generated images for personal, non-commercial purposes, including saving them, sharing with friends or family, and communicating with a hairstylist. You may not resell them at scale, sell them as a stock library, or misleadingly present them as authentic photography, professional diagnosis, or third-party-endorsed results.
6. Prohibited Conduct
You may not:
- Upload, analyze, or alter another person's photo without permission;
- Create or distribute non-consensual face swaps, impersonation, fraud, defamation, harassment, or deceptive content;
- Create sexualized, exploitative, or other unlawful content involving minors;
- Violate privacy, publicity, copyright, trademark, or other legal rights;
- Use outputs for unlawful advertising, identity fraud, political deception, or other conduct designed to make a fabricated event appear real;
- Bypass security, subscriptions, quotas, or content controls, or attack, interfere with, reverse engineer, or automate abusive use of the Service;
- Resell, rent, or use the Service as the core API of a paid third-party product without written permission; or
- Engage in other unlawful conduct or conduct that materially threatens the Service or its users.
We may refuse a generation, remove related content, or suspend an account to enforce these Terms, provider policies, or applicable law.
7. Subscriptions, Purchases, and Refunds
Some features may require an Apple App Store in-app purchase or auto-renewable subscription. Before purchase, the App displays the price, billing period, trial conditions, and included benefits.
- Apple charges your Apple ID account when you confirm a purchase.
- A subscription renews unless canceled at least 24 hours before the current period ends.
- Apple may charge the renewal within 24 hours before the current period ends.
- A free trial may convert to a paid subscription unless canceled in time.
- Manage or cancel through iOS “Settings → [your name] → Subscriptions” or Apple's subscription page.
- Eligible purchases may be restored in the App.
- Apple handles refund requests under its policies through Report a Problem.
Deleting your account, uninstalling the App, or stopping use does not cancel a subscription or automatically create a refund.
8. Intellectual Property
The App's software, interface, branding, copy, catalog content, and other materials provided by us or our licensors are protected by intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or otherwise exploit them.
General product suggestions and feedback are not confidential. You allow us to use them without charge to improve the Service, while personal information contained in feedback remains subject to the Privacy Policy.
9. Third-Party Services
The Service depends on Supabase, APIMart, OpenAI models, RevenueCat, Apple, Google, and other providers. Providers may update, restrict, or discontinue their services and apply their own privacy and service rules. We will reasonably maintain integrations but do not control third-party infrastructure or model availability.
10. Changes, Suspension, and Termination
We may modify, suspend, or discontinue part of the Service for maintenance, security, legal requirements, third-party changes, or business reasons. Paid benefits that cannot be delivered will be handled under applicable law and Apple rules.
You may stop using the App, cancel a subscription, or delete your account. Provisions that by their nature should survive, including content restrictions, intellectual property, liability limitations, and dispute provisions, remain effective after termination.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, that the Service will meet a particular expectation, or that AI outputs will be accurate, unique, suitable for commercial use, or produce a particular real-world hairstyle result.
You are responsible for deciding whether to follow hairstyle, coloring, or care suggestions and should consult a qualified professional where appropriate. We are not responsible for personal-care, haircut, coloring, or other decisions made in reliance on AI output.
Nothing in these Terms excludes warranties or liabilities that applicable consumer law does not allow us to exclude.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
Our aggregate liability for claims related to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim; liability for a free Service is limited to the minimum extent permitted by law. This limitation does not apply to fraud, willful misconduct, gross negligence, or liability that cannot legally be limited.
13. Indemnity
To the extent permitted by law, you are responsible for third-party claims and reasonable costs caused by your unlawful use of the Service, breach of these Terms, or violation of third-party rights. This provision does not reduce mandatory consumer rights.
14. Governing Law and Disputes
Before filing a dispute, the parties should first attempt to resolve it by contacting pytonsuper@gmail.com. If unresolved, either party may bring a claim in a court with jurisdiction under applicable law. These Terms do not limit non-waivable U.S. state or federal consumer rights and do not require a waiver of class actions, jury trials, or other statutory procedures.
15. Changes to These Terms
We may update these Terms. For material changes, we will provide notice in the App, update the date above, or use another reasonable method. A change requiring separate consent will not apply before that consent is obtained.
16. General
- These Terms and the Privacy Policy form the entire agreement regarding the Service.
- If a provision is unenforceable, the remaining provisions remain effective.
- Failure to immediately enforce a right is not a waiver.
- You may not assign these Terms without written consent. We may assign them with a transfer of the Service, but not in a way that reduces statutory rights.
- The English version controls where multiple translations are provided, except where applicable law requires another language or a consumer-favorable interpretation.
